Brumatestore Terms of Purchase
These Terms of Purchase (“Terms”) govern all transactions between you (“Customer” or “you”) and Brumatestore (“we”, “us”, or “our”) for the purchase of tumblers, drinkware, coolers, and other products (collectively “Products”) through our website brumatestore.com. By placing an order with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Refund Policy (collectively “Governing Policies”). 1. Order Placement & Confirmation
Your submission of an order through our website constitutes a binding offer to purchase the Products listed in your order. We reserve the right to accept or reject your order in whole or in part, for any reason, including but not limited to stock shortages, pricing errors, or suspected fraudulent activity.
- Order Confirmation: Upon receipt of your order, we will send a preliminary order acknowledgment email. This email does not constitute order acceptance. A formal order confirmation email, containing your order number, Product details, and shipping information, will be sent once we have verified stock availability and payment validity—this email signifies our acceptance of your order.
- Accuracy of Order Information: You are responsible for providing accurate and complete information (e.g., shipping address, contact details) when placing an order. We are not liable for delays, non-delivery, or additional costs resulting from incorrect or incomplete information provided by you.
2. Pricing & Payment
All Product prices displayed on our website are in United States Dollars (USD), and all transactions are processed in USD. We strive to ensure pricing accuracy, but we reserve the right to correct pricing errors and notify you of any adjustments before processing your order.
- Payment Methods: We accept major credit cards (Visa, Mastercard, American Express, Discover), PayPal, Apple Pay, and Google Pay. All payments are processed securely through our third-party payment processors, and we do not store your full payment card details.
- Payment Authorization: By placing an order, you authorize us to charge the total order amount (including applicable taxes) to your selected payment method. If payment is declined, we will notify you, and your order will not be processed until valid payment is provided.
- Taxes: Prices do not include applicable sales, use, or import taxes. We will calculate and add any required taxes to your order total based on the shipping destination. For international orders, customs duties and import taxes are the sole responsibility of the Customer (see Section 4 for details).
3. Shipping & Delivery
We offer global free shipping with no minimum order requirement. All orders adhere to the following shipping and delivery rules:
- Order Fulfillment: We guarantee to ship all orders within one business day of order confirmation (i.e., orders placed on Monday will ship on Tuesday; orders placed on Friday/Saturday/Sunday will ship on Monday).
- Delivery Timeline: Regardless of domestic or international destination, all orders will arrive within 5 calendar days of shipment. Delivery timelines are subject to minor delays due to customs clearance (international orders) or unforeseen carrier disruptions, which we will communicate to you promptly.
- Shipping Notifications: Once your order ships, you will receive a shipping confirmation email with a tracking number to monitor delivery progress. It is your responsibility to track your order using the provided information.
- Address Changes: Requests to change the shipping address must be submitted within 6 hours of order confirmation. We cannot guarantee address changes after this window, as your order may already be in the fulfillment process.
4. International Orders
For orders shipped outside of the United States:
- Customs & Duties: You are solely responsible for all customs duties, import taxes, and brokerage fees imposed by the destination country. These fees will be collected by the shipping carrier upon delivery, and we are not liable for any delays or additional costs resulting from customs processing.
- Regulatory Compliance: You confirm that the Products you are purchasing comply with all import regulations and restrictions of the destination country. We reserve the right to refuse international orders to countries with restricted trade policies.
5. Returns & Refunds
Our return and refund policies are designed to ensure your satisfaction while protecting the integrity of our Products. All returns and refunds are subject to the following rules:
- Return Eligibility: You may request a return within 60 calendar days of delivery. Products must be unused, undamaged, and in their original packaging with all tags and accessories intact. Customized Products (e.g., engraved tumblers) are eligible for return only if they arrive defective or with manufacturing errors.
- Return Process: To initiate a return, email our support team with your order number, reason for return, and photos of the Product (if defective). We will provide a Return Authorization (RA) number and prepaid shipping label (global coverage). Returned Products must be shipped within 10 business days of receiving the RA.
- Refund Processing: Once we receive and inspect the returned Product (typically 3–5 business days after delivery to our warehouse), we will initiate a refund to your original payment method. Refunds will be processed within 5–10 business days of inspection, and you will be notified via email once the refund is issued.
- Non-Refundable Items: Shipping costs (waived for all orders) are not applicable for refunds. Products returned without a valid RA number or that fail inspection (e.g., used, damaged) will not be eligible for a refund and may be returned to you at your expense.
6. Product Availability & Descriptions
We strive to maintain accurate Product descriptions and stock levels on our website, but we do not guarantee that all descriptions are error-free or that all Products are always in stock.
- Stock Shortages: If a Product in your order is out of stock after order confirmation, we will notify you immediately and offer a choice between a full refund, a replacement with a similar Product (at no additional cost), or a backorder with priority shipping once the Product is restocked.
- Product Variations: Due to differences in monitor displays, the actual color or appearance of Products may vary slightly from the images on our website. Such variations do not constitute a defect and are not eligible for return.
7. Order Cancellation
You may cancel your order without penalty if you submit a cancellation request via email ([email protected]) within 6 hours of order confirmation. If your order has already been shipped, you must follow the return process outlined in Section 5 to obtain a refund.
We reserve the right to cancel any order if we suspect fraudulent activity, violation of these Terms, or if the order is for Products that are prohibited or restricted by law.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Brumatestore shall not be liable for any indirect, incidental, consequential, or punitive damages (including but not limited to loss of use, loss of profits, or delays) arising from your purchase or use of our Products, or from any breach of these Terms. Our total liability to you for any claim related to your order shall not exceed the total amount paid for the Products in that order.
This limitation does not apply to damages caused by our gross negligence, willful misconduct, or failure to comply with applicable consumer protection laws, or to damages for personal injury or property damage resulting from defective Products.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.
Any disputes arising from or related to these Terms or your order shall first be resolved through good-faith negotiation with our support team. If negotiation fails, the dispute shall be submitted to binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association. Arbitration awards shall be final and enforceable in any court of competent jurisdiction.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in business practices, applicable laws, or regulatory requirements. When we make changes, we will revise the “Last Updated” date at the bottom of this page and post the revised Terms on our website. Your continued use of our services or placement of orders after the effective date of the revised Terms constitutes your acceptance of the changes.
